Terms of Use for Ember

These Terms of Use ("Terms") are a legal agreement between you and [DEVELOPER LEGAL NAME] ("we", "us", "our") covering your use of the Ember app for iPhone and iPad ("Ember", "the app").
This agreement is between you and us only — **not with Apple**. Apple is not responsible for Ember or its contents.
By downloading or using Ember, you agree to these Terms. If you do not agree to them, do not use the app.
1. Licence
We grant you a personal, non-transferable, non-exclusive licence to use Ember on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.
You may not sell, rent, lease, redistribute, sublicense or modify the app, or attempt to derive its source code, except where such a restriction is prohibited by applicable law.
2. Purchases and subscriptions
Ember is free to download. Optional extra features are offered as **Ember Pro**, available in two forms:
- **Ember Pro Monthly** — an auto-renewable subscription, $1.99 (USD) per month
- **Ember Lifetime** — a one-time purchase, $20.00 (USD), which unlocks the same features permanently and does not renew
Prices are shown in your local currency, and Apple confirms the exact amount before you buy.
Auto-renewal
Payment is charged to your Apple Account when you confirm the purchase. An Ember Pro Monthly subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period, at the price stated above.
Managing and cancelling
You can manage your subscription and turn off auto-renew at any time after purchase, in iOS Settings › [your name] › Subscriptions, or in the App Store app. Cancelling stops the next renewal — it does not shorten or refund the period you are already in.
Free trials
If a free trial is offered and you buy a subscription before the trial ends, any unused portion of the trial is forfeited.
Refunds
All payments are handled by Apple, not by us. We cannot process refunds. Refund requests go to Apple at reportaproblem.apple.com and are decided under Apple's policies.
3. Your data
Ember does not require an account and does not collect personal information. What the app records stays on your device.
4. Acceptable use
Use Ember lawfully. Do not use it in any way that breaks applicable law, interferes with the app's operation, or attempts to gain unauthorised access to any system.
Ember is a timer and a record of time you choose to log. It is not a medical device and does not provide medical, psychological or health advice.
5. Maintenance and support
We are solely responsible for providing any maintenance and support for Ember. **Apple has no obligation whatsoever to furnish any maintenance or support services** for the app. If you need help, email mirzaabuzarmunir@gmail.com.
6. Warranty
To the maximum extent permitted by applicable law, Ember is provided "as is" and "as available", without warranty of any kind.
In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by applicable law, **Apple has no other warranty obligation whatsoever** with respect to Ember. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our sole responsibility.
Nothing in these Terms removes statutory rights you have as a consumer that cannot be excluded or limited by law.
7. Limitation of liability
To the extent permitted by applicable law, we are not liable for indirect, incidental or consequential loss arising from your use of Ember, including lost data or lost time records.
8. Product claims
We, not Apple, are responsible for addressing any claims from you or any third party relating to Ember or your possession and use of it, including: (i) product liability claims; (ii) any claim that Ember fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
9. Intellectual property
Ember — its name, design, clock faces, artwork and code — is owned by us and protected by copyright and other laws. In the event of any third-party claim that Ember or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
10. Legal compliance
You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
11. Third-party terms
You must comply with any applicable third-party terms of agreement when using Ember.
12. Apple as third-party beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right — and is deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary.
13. Termination
These Terms remain in effect until terminated by you or by us. Your rights under them end automatically if you fail to comply with any of their provisions. You may end them at any time by deleting the app from your devices.
14. Changes to these Terms
We may update these Terms. When we do, the date at the top of this page changes, and the current version is always available at [TERMS URL]. Continuing to use Ember after an update means you accept the revised Terms.
15. Governing law
These Terms are governed by the laws of US, excluding its conflict-of-laws rules, and except where local consumer law grants you rights that cannot be overridden by agreement.
